Prison sentence confirmed in construction fraud case

A state prison sentence imposed on a former Huntingdon County contractor accused of home improvement fraud has been upheld by the Pennsylvania Superior Court.

Entrepreneur, Kristopher Jay Gardner, 56, who now lives in Pittsburgh, was sentenced last November by Huntingdon County Judge George N. Zanic to 8.5 to 17 years in prison for defrauding two landlords .

In 2017, the two owners gave him money for materials so he could install metal roofing on their homes.

Gardner never completed the projects, according to the opinion issued last week by a panel of three state Superior Court judges.

He was initially charged with two counts of deceptive or fraudulent business practices, but the prosecution eventually escalated the charges to home improvement fraud.

The settlement of the case against Gardner has experienced delays due to the COVID-19 pandemic.

He was only brought to trial on March 9, 2021, and once the prosecution concluded their case against him, he decided to plead guilty to both counts instead of proceeding with a verdict.

In May 2021, the judge imposed a sentence that involved less jail time if Gardner returned the victims $5,640.

Despite his promise of restitution, he never found the money and he was sentenced to a long term behind bars.

The Pennsylvania Department of Corrections locator says Gardner is serving his sentence at SCI Rockview in Center County.

Gardner, through Huntingdon attorney Christopher B. Wencker, appealed his conviction and sentence to the Superior Court, arguing that his sentence was “grossly excessive”.

The sentence, the defense said, exceeded the standard sentencing range recommended by state guidelines, and it failed to take into account Gardner’s acceptance of responsibility for his actions, his remorse and his efforts to pay. restitution.

The defense also complained that the increased charges against him by the prosecution violated his right to a fair trial.

The Superior Court panel in its 14-year opinion dismissed the defense arguments.

The appeals court cited Zanic’s opinion extensively in deciding the Gardner case.

“The trial court (Zanic) found in light of the full extent of (Gardner’s) conduct, his criminal history, his repeated attempts to escape meaningful punishment for his action and his schemes repeated regarding restitution, a sentence outside the guidelines is appropriate here. ”

“We agree,” said the opinion written by Superior Court Judge Correale Stevens.

Zanic explained in his opinion, “We have two victims who have not been healed. One of the victims is an elderly victim. They haven’t had any money for four years.

The Superior Court panel, which also included Justices Deborah A. Kunselman and Daniel McCaffery, dismissed defense complaints that the increased charges deprived Gardner of a fair trial.
